Van hierdie bronne speel verdrae die belangrikste rol, want dit gee aan state (en internasionale organisasies) die geleentheid om ooreenkomste so akkuraat as moontlik te maak. In baie opsigte lyk 'n verdrag dus na 'n kontrak in die nasionale regsorde. In die meeste lande moet 'n internasionale verdrag eksplisiet of stilswyend deur die parlement goedgekeur word. Die staat self bekragtig dit dan. Die verdragstate word dan intern (teenoor die burgers) en ekstern (teenoor die ander verdragstate) gebind.
